2. CONDITIONS OF USE

Users of the site acknowledge that they have read these instructions for use and undertake to comply with them.
SMEG reserves the right to modify this manual at any time.
The user therefore undertakes to consult it regularly.
In the event that the user accesses the site from a country other than Monaco, the user also undertakes to ensure compliance with the locally applicable legislation.

3. SITE CONTENT

The site may give access to other sites not belonging to SMEG, which may have their own legal notices; these should be consulted and respected.
The information provided on the site is for information purposes only. SMEG cannot guarantee that the information published on the site is accurate, complete or up-to-date. It does not exempt the user from carrying out an appropriate additional analysis.
SMEG cannot therefore be held responsible for any errors or omissions, or for the unavailability of information and services. Subsequently, users acknowledge that they will use this information under their sole responsibility.
SMEG may not therefore be held liable for any direct or indirect damage or interest that may result from access to or use of the site, including but not limited to inaccessibility, loss of data and/or the presence of viruses on the site.

4. GENERAL TECHNICAL INFORMATION

The user of the site undertakes to:

5. PERSONAL INFORMATION

In accordance with the provisions of Law no. 1165 of 23 December 1993 on the protection of
personal data, as amended, the processing of personal data on the site by SMEG, the data controller, has been authorised by the Commission de Contrôle des Informations Nominatives (CCIN).
The user is hereby informed that their personal data, which is collected as part of the management of
their contract, subscription to the online service, contact forms or any other questionnaire on the https://www.mobee.mc website, will be processed by SMEG.
The information collected is for use by SMEG, its service providers and any commercial partners.

This information is used for automated processing for the following purposes:

  • Management of customer account creation via the Mobee website
  • Management of customer account creation via the Mobee application
  • Vehicle geolocation management

It is kept strictly confidential and is intended for the exclusive use of SMEG's members and
departments and those of its service providers and any commercial partners.
The personal information collected in this way is not transferred, exchanged or rented out. Certain
specific information requested in the online subscription forms is mandatory.
If the user does not provide this information, SMEG will not be able to process the corresponding files.

In accordance with Law no. 1165 of 23 December 1993 on the protection of personal data, as amended, users have the right to access, oppose and rectify any data concerning them, which they may exercise by sending an e-mail from the contact section.
Users are required to comply with the provisions of the aforementioned law, and any breach of it may result in criminal penalties.
More specifically, they must refrain from collecting or misusing any personal information which they have access, and in general from any act likely to infringe the privacy or reputation of individuals.

6. COOKIES

When visiting the site, users are informed that a cookie may be automatically installed on their browser. This is a block of data which is not used for identification purposes but which is used to record information relating to the user's browsing on the site. It is used to analyse visitor numbers and measure audience figures in order to improve the quality of the site.
Users may disable the use of cookies by selecting the appropriate browser settings.However, deactivating them may prevent the use of certain functions on this site. If you refuse to accept cookies, certain services will no longer be accessible.
Users have the right to access, rectify or delete their personal data communicated via the "cookie" under the conditions indicated in Article 5.

7. INTELLECTUAL PROPERTY

The images, logos and content on this site are protected or are protectable by intellectual and industrial property rights. Any extraction, exploitation, reproduction, representation or use of the latter without the express prior written authorisation of SMEG is strictly prohibited.
The general structure, software, texts, images, videos, sounds, know-how, animations, and more generally all the information and content appearing on the site, are the property of SMEG or are subject to a right of use or exploitation.
The reproduction, copying, exploitation, modification, distribution or use for commercial purposes constitutes a criminal offence punishable by the Courts of Monaco in accordance with the legislative provisions in force.
The same applies to the trademarks and/or logos owned by SMEG which appear on this site and which are trademarks protected by intellectual property law in accordance with the legislative provisions in force.
Any databases appearing on the site is the exclusive property of SMEG. SMEG expressly prohibits any re-use, reproduction or extraction of elements of these databases. Any unauthorised re-use, reproduction or extraction will incur the user's liability.
SMEG reserves the right to delete without delay, and without prior notice, any content: messages, text, images, graphics, which contravene the laws and regulations in force, and
in particular, the regulations specified above.
Should the user wish to use any of the content of the site (text, images, etc.), they must
obtain SMEG's express prior written authorisation by post or by sending an e-mail to the addresses indicated in Article 1.

8. LINKS

The links set up on the site leading to external internet sites have been the subject of prior and express authorisation.
However, as SMEG is not the publisher of these sites, it cannot control their content. As
a result, SMEG may not under any circumstances be held responsible for the content of sites accessible in this way, or for any collection and transmission of personal data, installation of cookies or any other process designed to achieve the same ends, carried out by these sites.
Users may not set up a hypertext link to the site without SMEG's express prior written authorisation. Requests should be addressed to the site's publication manager.

9. MANAGEMENT OF ACCESS CODES AND PASSWORDS

Certain interactive services, particularly the customer areas and user areas of the
MOBEE service, require an access code and password which are defined by the Users.
These access codes and passwords are confidential, personal, non-transferable and non-transmissible.
The user is responsible for their management, conservation and the consequences of their use. It
is the responsibility of the user to take the necessary steps to protect and
preserve them. SMEG may under no circumstances be held responsible for any fraudulent use.
SMEG reserves the right to suspend access to the site in the event of any fraudulent or attempted fraudulent use of the password or user access code.
SMEG will inform the user if access is suspended.
The law applicable to the site is Monegasque law.
Most of the online content and services on the site are available in French and English.
In the event of a dispute, the French version shall prevail.
